These Terms & Conditions govern the services provided by The Picturnity Studio ("The Picturnity Studio," "Artists," "We," "Us," "Our") to the client ("Client," "You," "Your"). By hiring our services, you agree to the following terms:

 

1. Service Completion Schedule

The Client agrees that no part of the event package, including previews (if any), will be delivered until the outstanding balance is paid in full. Digital copies of photos and videos will be provided to the Client after the event in the form of an online photo gallery or another medium, assuming the outstanding balance has been paid in full.

2. Compensation for Services Rendered

The Client agrees to pay the full fee for photography or videography services as outlined in the contract signed at the time of booking the service. The payment schedule provided by The Picturnity Studio must be followed. If payments are not made on time or not made in full, The Picturnity Studio reserves the right to terminate services/withheld data until receiving of full payment without any liability. All payments are non-refundable, except in cases explicitly stated within contract terms.

3. Copyright 

• The Picturnity Studio/artist retains full copyright ownership of all photographs and videos taken during the event. We reserve the right to use these images and videos for and promotional purposes, including but not limited to portfolios, social media, websites and marketing materials.

• Clients may reproduce or share images for personal or internal use but must seek written permission before using them for commercial purposes or selling them for profit. If the Client wishes to restrict the use of images on public platforms, they must notify The Picturnity Studio at picturnity@gmail.com prior to or during the event.

• The Client grants The Picturnity Studio the right to use any photographs or videos taken during the event in which the Client and any attendees are present for promotional, portfolio, or marketing purposes. If any attendees object to their likeness being used, it is the Client’s responsibility to inform The Picturnity Studio in writing prior to the event. The Picturnity Studio shall not be held liable for any future claims or disputes related to the use of attendees’ likenesses unless explicitly informed. In case the client want to request removal of any content they may reach out to us on picturnity@gmail.com

 

4. Delivery and Data Preservation

• The Picturnity Studio will make every effort to deliver the final products within the committed time frame as outlined in the contract. However, The Picturnity Studio is not liable for any delays or non-delivery of services/products if the Client has not made the complete payments. The timely receipt of payment is essential for the The Picturnity Studio to fulfil its obligations, and any delay in payment may result in a delay/ non-delivery of the final products.

• The Client is required to make a timely selection of images for the creation of the physical photo album and/or photo frame. The Picturnity Studio will not be held liable for any delay or non-delivery of the photo album or photo frame if the Client fails to make their image selection within the specified time frame. In such cases, The Picturnity Studio will not be liable for a refund or any other compensation related to the non-delivery of the album or photo frame.

• The Picturnity Studio will store and preserve all event-related data for six months following the event date. After this period, The Picturnity Studio will not be held responsible for any data loss. Clients are advised to select images for albums/photo frames etc within this six-month period. Any requests after this for video/images editing revisions  will not be accepted.

• In the event that the Client loses their data and requests it from The Picturnity Studio after six months of the event, The Picturnity Studio will make reasonable efforts to provide the Client with their full or partial data, provided that the data is still available in The Picturnity Studio's archives. However, The Picturnity Studio is not liable for any data loss that occurs after the six-month retention period, and retrieval of data will depend on its availability at the time of the request.

5. Editing, Revisions & Complimentary Service

• We provide professionally edited videos (e.g., films, trailers, highlights, reels) and photographs as part of our service. The Client is entitled to up to two rounds of revisions free of charge. Any additional revisions requested by the Client will incur a fee, which will be communicated by The Picturnity Studio.

• Any complimentary services or products offered by The Picturnity Studio, such as a complimentary photo frame or digital invite, are subject to availability and are provided at the discretion of The Picturnity Studio. These items are not subject to free revisions or customization. The Client understands and agrees that these items will be delivered as is, and no changes to the design, style, or content will be entertained without additional charges. Requests for revisions or alterations to complimentary items will incur a fee, which will be communicated by The Picturnity Studio.​​

6. Limitation of Liability

In the unlikely event that any digital files are lost, stolen, or destroyed for reasons beyond our control, including but not limited to equipment malfunction or technical errors, The Picturnity Studio’s liability will be limited to returning all payments made, minus the 10% booking fee. We shall not be held liable for emotional distress or further claims beyond the amount paid by the Client.

 

7. Force Majeure

The Picturnity Studio shall not be held responsible for any failure or delay in performing its obligations under this agreement if such failure or delay is due to causes beyond its reasonable control, including but not limited to fire, natural disasters, act of god, strikes, pandemics, or governmental restrictions.

 

8. Client Responsibility

• The Client agrees to cooperate with The Picturnity Studio by following the agreed schedule(such as sharing location, time of events before hand) and providing all necessary information for successful service delivery. This includes ensuring the availability of individuals to be photographed or filmed, providing access to the venue, and coordinating with other vendors. The Picturnity Studio is not responsible for missed shots or video footage due to a lack of Client or guest cooperation.

• It is the Client's responsibility to ensure all required permissions and permits for the event venue, as well as all necessary information for the successful completion of the services, are provided to The Picturnity Studio on time. The Picturnity Studio will not be liable for delays or disruptions caused by the Client’s failure to provide this information.

• Image selection for Albums / Photo Frames - The Client acknowledges that the selection of images for the photo album and photo frames is their responsibility. The Picturnity Studio will provide all images to the client, and the Client must make their selections within six months from the event date. If the Client fails to select the images within a timely manner to this period, The Picturnity Studio will not be held liable for any delays in the production or non-delivery of the photo album or photo frames. 

 

7. Cancellation and Rescheduling

In case of cancellation by the Client, any payments made up to the point of cancellation are non-refundable. If the Client wishes to reschedule the event, this must be done at least 30 days in advance. Rescheduling may incur additional charges depending on the The Picturnity Studio’s availability and other factors.

 

8. Creative Control

The Client acknowledges that the Picturnity Studio has full creative control over the final edited photographs and videos. The Picturnity Studio will make every effort to ensure the Client’s vision is fulfilled; however, editing style, lighting, angles, and other artistic choices remain at the discretion of The Picturnity Studio. Requests for specific edits beyond the agreed revision rounds will incur additional fees.

9. Event Interruptions

The Picturnity Studio is not responsible for compromised coverage due to causes beyond its control, including but not limited to obstructions, lighting issues, inclement weather, or delays caused by the Client, guests, or the event schedule. It is the Client’s responsibility to ensure that the event proceeds in a timely manner and that the necessary conditions are met for The Picturnity Studio to provide optimal service.

 

10. Equipment Damage or Loss

In the event that any equipment belonging to The Picturnity Studio is damaged, lost, or stolen during the event due to the actions of the Client or event attendees, the Client will be held responsible for the costs of repair or replacement.

 

11. Health and Safety

The Picturnity Studio and its artists/staff reserve the right to terminate coverage and leave the location of the event if they experiences inappropriate, threatening, hostile, or offensive behaviour from the Client or event attendees, or if the environment becomes unsafe for The Picturnity Studio’s artists/staff or equipment. In such cases, no refunds will be provided, and the Client will be responsible for any additional costs incurred by The Picturnity Studio.

 

12. Unforeseen Circumstances

If the artists (photographer or videographer) are unable to perform their duties due to illness, injury, emergency, or other unforeseen circumstances, The Picturnity Studio will make every reasonable effort to find a substitute photographer or videographer with client’s consent. If a substitute cannot be found, liability is limited to a refund of payments made, minus any services already rendered.

 

13. Communication of Disputes, Requests or Issues

Any disputes, issues, or requests related to the services provided must be communicated to The Picturnity Studio via email at picturnity@gmail.com. The The Picturnity Studio will not accept or address complaints, disputes, or requests made over the phone/ WhatsApp/Text Messages or Social media platforms. The Client agrees to provide detailed information regarding any concerns in writing, allowing The Picturnity Studio to respond promptly and efficiently.

14. Amendments

The Picturnity Studio reserves the right to amend these Terms & Conditions from time to time without prior notice. Clients are advised to check for updates regularly.
